These Terms of Service ("Terms") form a binding legal agreement between you ("you," "user," or "trader") and ETW governing your access to and use of our website, platform, and services available at ethwiz.space and ethwiz.online (collectively, the "Service"). By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. 1. Who We Are

ETW Journal is a professional trading journal and performance-analytics platform built for traders using ICT (Inner Circle Trader) and Smart Money Concepts methodologies, as well as traders of any style. We provide tools to log trades, track performance metrics, analyse trading psychology, and build consistent discipline across forex, crypto, indices, futures, and other instruments.

2. Eligibility

You must be at least 18 years of age, and have the legal capacity to enter into a binding contract in your jurisdiction, to create an account or use the Service. By using ETW Journal you represent and warrant that you meet these requirements and that your use of the Service does not violate any law or regulation applicable to you.

3. Account Registration & Responsibilities

To use most features of ETW Journal you must create an account using a valid email address and password, or by authenticating through a supported third-party provider (e.g., Google). You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Keep your login credentials confidential and not share your account with any other person
• Notify us immediately at our support contact if you suspect unauthorised access to your account
• Accept full responsibility for all activity that occurs under your account, whether or not authorised by you

We are not liable for any loss or damage arising from your failure to safeguard your account credentials.

4. Subscriptions, Free Trials & Billing

ETW Journal may offer free access tiers, free trial periods, and paid subscription plans. Where a paid plan is offered:

• Fees are billed in advance on a recurring basis (monthly or annually, as selected) and are shown to you before you subscribe
• Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period, and you retain access until then
• Except where required by law or expressly stated at the time of purchase, fees already paid are non-refundable, including for partial billing periods or unused features
• We may change our pricing or plans, and will provide reasonable advance notice before any change takes effect for existing subscribers
• Failed or declined payments may result in suspension of paid features until payment is resolved

5. Acceptable Use

ETW Journal is a tool for personal trading analysis, record-keeping, and education. You agree not to:

• Use the Service for any unlawful, fraudulent, or unauthorised purpose
• Attempt to reverse-engineer, decompile, scrape, or extract data or source code from our systems
• Probe, penetration-test, or attempt to bypass any security or authentication measure without our prior written consent
• Upload content that is unlawful, harmful, abusive, defamatory, or that infringes any third party's intellectual property or privacy rights
• Share, resell, sublicense, or provide access to your account or the Service to any third party
• Use automated means (bots, scripts) to access the Service except through any API we may officially publish
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure

We reserve the right to investigate and take appropriate action, including account suspension or termination, against anyone who violates this section.

6. Not Financial Advice

ETW Journal is a journaling, record-keeping, and analytics tool only. Nothing on the Service — including statistics, tags, notes, or any feature — constitutes financial, investment, tax, or trading advice, nor a recommendation to buy, sell, or hold any financial instrument. All trading and investment decisions are made solely by you, at your own risk. Trading financial markets involves substantial risk of loss and is not suitable for every investor. Past performance recorded in the journal is not indicative of future results. ETW, its founders, employees, and affiliates accept no liability whatsoever for trading losses, missed opportunities, or financial outcomes of any kind arising from your use of the Service.

7. User Content & Data You Submit

You retain ownership of the trade data, notes, screenshots, and other content you submit to the Service ("User Content"). By submitting User Content, you grant ETW a limited, non-exclusive licence to host, store, process, and display that content solely for the purpose of providing and improving the Service to you. We do not claim ownership of your User Content and do not use it to train third-party products or sell it to advertisers.

8. Intellectual Property

All content, design, branding, source code, and software comprising ETW Journal — including the "ETW" and "Ethereum Wizard Trades" names, logos, and trade dress — are the property of ETW or its licensors and are protected by intellectual property laws. Except for the limited right to use the Service as intended, you may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written permission.

9. Data & Privacy

Your trade data and personal information are handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference. We do not sell your personal data to third parties.

10. Service Availability & Modifications

We aim to keep ETW Journal available at all times but do not guarantee uninterrupted, error-free, or secure access. We may modify, suspend, or discontinue any feature of the Service, temporarily or permanently, with or without notice, for reasons including maintenance, security, or product changes.

11. Termination

We reserve the right to suspend or terminate your account, with or without notice, if you violate these Terms, engage in fraudulent or abusive behaviour, or if required by law. You may delete your account and stop using the Service at any time by contacting us through the channels below. Upon termination, your right to use the Service ceases immediately; certain data may be retained as described in our Privacy Policy.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, accurate, or free of errors or data loss.

13. Limitation of Liability

To the fullest extent permitted by law, ETW, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or trading losses, arising out of or related to your use of, or inability to use, the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless ETW and its founders, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

15. Governing Law & Dispute Resolution

These Terms are governed by applicable law without regard to conflict-of-law principles. Before pursuing formal legal action, you agree to first contact us to attempt to resolve any dispute informally. Nothing in this section limits either party's right to seek injunctive or equitable relief where appropriate.

• Support communications: messages you send us via in-app support chat or email, including your email address and message content
• Usage & device data: basic technical data such as browser type, device type, general session activity, and approximate location (derived from IP address) to help us secure and improve the platform

2. How We Use Your Information

We do not use your trading data for advertising, behavioural profiling, or sell it to third parties. We do not use your journal content to train third-party AI models.

3. Legal Basis for Processing (EEA/UK Users)

If you are located in the European Economic Area or United Kingdom, we process your personal data on the basis of: performance of our contract with you (providing the Service), our legitimate interests (securing and improving the Service), your consent (where applicable, e.g. certain cookies), and compliance with legal obligations.

4. Data Storage & Security

Your data is stored using Google Firebase (Authentication and Firestore), a widely used cloud platform with industry-standard encryption in transit and at rest. Trade screenshots may be stored via Cloudinary. Access to your account data is scoped strictly to your own account — no other user can view your trades, notes, or personal information. While we take reasonable technical and organisational measures to protect your data, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

5. Google Sign-In

When you sign in with Google, we receive your name, email address, and profile photo from Google's OAuth service. We do not receive or store your Google password. Google's own Privacy Policy governs how Google handles your data.

6. Cookies & Local Storage

ETW Journal uses essential authentication tokens and local storage in your browser to keep you signed in and to remember basic preferences (such as an active support conversation). We do not use advertising cookies, third-party ad trackers, or cross-site tracking pixels.

7. Data Retention

Your trade data and account information are retained for as long as your account remains active, or as needed to provide you the Service. If you request account deletion, we will delete or anonymise your personal data within a reasonable timeframe, except where we are required to retain certain records (e.g., billing records) for legal or accounting purposes.

Depending on your location, you may have the right to:

• Access the personal data we hold about you
• Request correction of inaccurate or incomplete data
